Opening a children’s home in the UK requires more than good intentions. It’s a regulated profession governed by national care legislation and enforced by independent regulators. You must register before opening and meet a wide range of standards in care, safeguarding, and leadership.
Register with the correct UK regulator
Before you can operate, your children’s home must be registered and inspected by the appropriate national regulator:
- England – Ofsted (ofsted.gov.uk)

- Scotland – Care Inspectorate (careinspectorate.com)
- Northern Ireland – Regulation and Quality Improvement Authority (rqia.org.uk)
You must not operate a children’s home without registration. Doing so is a criminal offence under the Care Standards Act 2000.
Understand key legislation
In England, children’s homes are governed by several legal frameworks:
- Care Standards Act 2000 – the foundation for registration and regulation.
- Children Act 1989 and 2004 – defines local authority duties and children’s rights.
- Children’s Homes (England) Regulations 2015 – sets out operational requirements.
- Quality Standards – nine statutory standards covering welfare, health, education, and leadership.

Know the registration process
Before you can admit children, you must complete a formal application:
- Submit a Statement of Purpose, location risk assessment, and all required policies.
- Complete the SC1 and SC2 forms (in England) for provider and manager registration.
- Attend fit person interviews with Ofsted or your regulator.
- Prepare for a pre-registration inspection.
- Only begin operations once you receive your certificate of registration.
